Really Bad Precedent: Allowing Governments to Tax Non-Constituents

The Supreme Court is currently considering South Dakota v Wayfair. A case debating whether or not state and municipal governments can collect their respective sales taxes – on non-resident business and people who have the temerity to complete a transaction in their jurisdictions.

President Donald Trump is on this absolutely correct – in one sense. Online retailers like the case-cited Wayfair – do have a tax-less advantage over brick-and-mortar stores in localities that impose sales taxes.

If you live in one or more sales tax jurisdictions and you shop brick-and-mortar – you pay the sales taxes. If you live there and shop Wayfair – you do not necessarily render unto Caesar. (Some online companies – Amazon, for instance – collect many of the sales taxes in much of the nation.) More

In Perpetuity

We’ve oft noted the government’s inability to do well…just about anything.

It’s why our Founding Fathers drafted our Constitution to severely proscribe what the federal government is supposed to do. And why they highly recommended all other levels of government follow their limited prescription.

We less government types see our $4-trillion-per-year federal government – and are rendered nauseous. The Feds are doing countless things the Constitution says they shouldn’t be doing.

So we less government types look for any way of which we can think to minimize the government’s role in any of them. As we look to for any way possible to compromise with the unyielding Government-Should-Do-Everything types.

One of the “half-loaf” ways we have attempted to minimize ever-so-slightly government doing quite so much – is to have the government contract out things to the private sector.

Our thinking being: The private sector does everything better than government (and it absolutely does) – so having the private sector handle something for the government will improve the performance and price of that something. More

Those of us who didn’t succumb to government schools – know of the horrendous days of Democrat President Franklin Delano Roosevelt and his hyperactive, spastic, shotgun-style approach to government.

Completely clueless on how to address the Great Depression, Roosevelt’s administration chose to spasmodically fire government money in nigh every direction. Hoping to spray enough bureaucratic coin to cover the Earth – and thereby mitigate the damage…his own overactive government was massively exacerbating.

Perhaps Oprah Winfrey came upon her idea to give everyone in her audience a car – by researching the Roosevelt administration.

Fortunately for us – so did the Founding Fathers. And they drafted and ratified the Constitution to do exactly that – limit the federal government’s activities to a few, specifically proscribed things.

And the Founders strenuously recommended that state and local governments not do very much either. Because they knew a fundamental truth of life:

Maryland has one of our nation’s more oxymoronic state nicknames: “The Free State.”

Oxymoronic – because the decades-now Democrat-dominated state legislature has spent their time and legislative effort ensuring that everything in “The Free State”…is inordinately expensive.

Most especially government. In 2016, Maryland was the most taxed state in the union. Maryland Democrats are so tax-happy, they were even taxing…the rain.

But in November 2016 – something wonderful happened. The good people of Maryland very wisely elected as Governor – Republican Larry Hogan. Who ran in no small part on a copious tax-cutting platform.

And once elected, Hogan kept his word. Gone was the very obnoxious rain tax – despite vociferous Democrat objection – and many other levies and fees.

But Democrats will not go quietly into that less-tax night. They have just passed a huge new tax increase. And done so – under the false flag of business tax “reform.” Behold SB 1090. More

I am a virulent free trader. I love commerce between nigh any peoples and nations with whom the exchanges are on equal footing – and as unfettered as possible by government intervention and imposition.

The problems arise – when we venture out into a world full of countries in love with government intervention and imposition.

Every nation on the planet has the inherent desire to tilt the commercial scales in their favor. I fully understand the aspiration – but we should demand it never become commercial policy.

Unfortunately, we have spent the last half century or so – allowing the world’s nations to do exactly that. Very much to our national detriment.

Net Neutrality is the Trojan Horse that gets the government very thoroughly into the business of regulating the Internet. The Internet being the place for nigh all things free speech and free market going forward.

Net Neutrality – is your one-stop-shop for all things government censorship and control of the Web.

Under the phony guise of “neutrality,” “equality” and “fairness” – the government would be able to do to the Internet exactly what, say, the Internal Revenue Service (IRS) did to President Barack Obama’s political opponents.

Only in a much more all-encompassing fashion – because the Internet is increasingly everything.

You see what Big Tech Facebook, Twitter and Google do to political people they don’t like? Instantaneous silencing and banishment.

Perhaps chief amongst them: If your political opponent is a Republican, the Left-Media will help you tie them up for months on end with charges of foreign “collusion” – with zero evidence whatsoever necessary to back the claim.

…makes it much more likely you’ll get government contracts.

We have said it many times before – and we will keep saying it until The Purge finally occurs:

President Donald Trump’s far-and-away biggest mistake as chief executive – was not making MANY more people depart the government upon his taking over its top spot.

Trump is currently in the midst of an additional round of small-bore house cleaning. But the Deep State is very, very un-shallow and inordinately un-narrow – and oh-so-much-more culling needs to be done.

To give but two sub-departmental examples:

Behold the United States Digital Service (USDS). And the Defense Department’s portion thereof: The Defense Digital Service (DDS).
