The Constitution’s First Amendment reads as follows:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

The emphasis is ours – so as to highlight the portion we are now going to discuss. We the People are free to assemble – or not assemble – any way we wish. Completely free from government interference or imposition.

Keep in mind that the Constitution’s drafters and ratifiers also delineated the separation and balance of powers. The Legislative Branch (“Congress”) was the only one of the three that was to initiate new interferences and impositions on the people (and were, again, only to do so within the strict confines of said Constitution). And most important of all – Search results. Before you can click, Tweet or Share something – you first have to find it. And if you’re scanning the Web for news using Google – far and away the most used search engine – you’re almost certain to get skewed Leftist results. More

Apple Training Their Sights on the US Economy

In Reality, stealing is bad. In Washington, D.C. – it is the operational model. A feature – not a bug.

So it is understandable that when a Donald Trump campaigns for President in part on halting theft abroad, DC Conventional Wisdom (which is neither conventional nor wisdom) – is that he will lose the election. His introduction and insertion of Reality – is utterly alien to the DC Geniuses.

The theft Trump highlighted with the greatest frequency – is the $600 billion (and likely more) per annum in intellectual property (IP) theft in which China and the rest of the world engages.

We invent and create things – and they steal them. Which does egregious damage to our economy now. And it is a woeful disincentive to our continuing to invent and create things – which does egregious damage to our economy going forward. More

The Utter Dumbness of the Bureaucracy ‘Comment Period’

The United States is a Constitutional republic. What does that mean?: “A constitutional republic is a state where the head of state and other officials are elected as representatives of the people, and must govern according to existing constitutional law that limits the government's power over citizens. In a constitutional republic, executive, legislative, and judicial powers are separated into distinct branches and the will of the majority of the population is tempered by protections for individual rights so that no individual or group has absolute power.” These divisions of government were emplaced here by our Founders - to also protect We the People from government. Each branch is supposed to serve its limited role - in the whole. When one branch starts doing things another branch is supposed to be doing - things quickly go awry, and government gets very big. Our Legislative Branch - is tasked with legislating. And only the Legislative Branch is so tasked. Its officials - whom We the People elect - write the laws under which we live. The Executive Branch - is headed by the President we elect. Who signs the laws passed by the Legislative. And then his Branch - executes. Millions (ugh, yes, millions) of unelected bureaucrats implement the laws written - as written. No more, no less. No Executive Branch agency can write a single regulation - unless they are first tasked with so doing by the laws of the Legislative Branch. And they must write the regs within the confines of the laws of the Legislative Branch. Anything else - and they are performing a cheap imitation of the Legislative Branch. Constitutionally - no bueno. Our federal register - the government’s catalogue of regulations - grows by thousands of pages every year (until, it appears, the arrival of President Donald Trump, God bless him.) Under ex-president Barack Obama the register grew exponentially - during a time of historic Congressional deadlock and inactivity. Which means these tens of thousands of pages of new regulations - were nearly all added completely untethered to any legislation. That’s the Executive - pretending to be the Legislative. Constitutionally - no bueno. One of the ways these agencies attempt to cover up their unilateral power grabs - is with a veneer of alleged We the People participation. Behold the utter dumbness of the “Comment Period.” Where some agency of which you’ve never heard - and to whom you’ve elected no one - quietly announces a period where you can file thoughts on the damage they’re about to inflict upon you. Of course, the Comment Period is entirely and solely Democracy Theater. (Again, we’re a republic, not a democracy.) Again, if the government wants to do something new - the process has to begin with legislation by the Legislative Branch. Not bureaucratic fiats by Executive Branch agencies. The Comment Periods - are just dumb. Again, these bureaucrats aren’t elected. And they are under no obligation whatsoever to have the comments you file - affect at all what they're about to do to you. If the comments favor the power grab they are about to execute - they trumpet the results, and move forward as planned. If the comments oppose - they ignore the results, and move forward as planned. And this nonsense - allows for much additional nonsense by outside pro-government Leftist groups. They get to turn the Democracy Theater - into Kabuki Theater. They enlist their armies of uninformed nonsense-spewers - to spew their nonsense into the comment process. To wit: The current cavalcade of inanity being shoved at the Federal Communications Commission (FCC). Trump’s FCC is in the process of undoing a huge Obama FCC power grab. Internet reclassification - to absurdly subject the Web to 1934 landline telephone law - so as to then impose the absurd Network Neutrality. A HUGE power grab - and titanically stupid policy. The Trump Commission is absolutely correct in undoing all of it. Because they are - we can count on the pro-government Leftist groups to screech bellicosely in opposition. Comments for the FCC on the Net Neutrality Proposal But the Comment Period results - have only served to reveal how dumb the Comment Period is. Oh - and how violent and racist the Leftists are. If they don’t know what it is - why have them comment upon it? Why have any portion of the bureaucracy's decision predicated upon the results? If Net Neutrality is so important to We the People - impose it the way the Constitution mandates it be imposed. Have our elected Legislative Branch officials convince us we need it - and then write law emplacing it. Pass it through both Legislative houses - and have the President sign it. And then - and only then - have the FCC impose it. Strictly and solely within the confines of the law directing the FCC to impose it. At this point, finally, nearly everyone is clambering aboard the Constitutional approach. Defining Dumbness Down

HBO Calls It ‘Last Week Tonight’ – Because ‘Cashing In’ Was Already Taken

HBO’s alleged comedian-host John Oliver (I’ve never found him to be particularly amusing) has the same problem a lot of wealthy Leftists have.

God has blessed Oliver (whether Oliver realizes it or not) – Oliver is wealthy. He makes a whole lot of money – in a field where maybe one in a thousand can even buy groceries plying their wares. Making it in entertainment is catching lightening in a bottle – twice.

Oliver makes huge coin – for a less-than-imperative service. He isn’t curing cancer. Nothing wrong with it – but he’s a court jester. Making as much as he does for what he does – leaves a lot of people in his position feeling almost like they’re cheating at life.

Many thus feel the need to crusade for causes – to make up for the incredible good fortune they enjoy. And when you aren’t a signally deep or practiced thinker – that oft means falling for the shallow facility of Leftism.

Oliver has fallen hard. And there’s no diving in his thought pool. More

Beware the Silicon Valley – and Thus the Web

For decades now, all of America’s major institutions – have been broadly, unquestionably Leftist, and rigidly opposed to any deviance from the entrenched doctrine.

Colleges and universities, Hollywood and entertainment, the Sciences and the News Media – all deeply in Leftism’s thrall.

And then there is the Silicon Valley – now the biggest, baddest, broadest institution of them all. Because of their dominance of the Internet – they have their hands in all of the legacy institutions.

The Silicon Valley has had for more than a decade a license to print money. And they bestow tens of millions of dollars of it in endowments to Leftist colleges – including tons of coin in directed “science” like global warming…oops, I mean climate change.

The Valley is out Hollywood-ing Hollywood – self-producing a great and growing number of movies and television shows. More

Before he was Politician Donald Trump – he was Businessman-TV Star Donald Trump. All along the way (check out this “Oprah” hit from all the way back in 1988), Trump championed a Reality-based approach to actually free, fair trade. On which he eventually campaigned – as he ran for his new entry-level political position.

Trump’s trade approach – was antithetical to the way Washington, D.C. had long been doing trade. The DC warped definition of “free trade” was:

We would accommodate every other nation on the planet – by removing our government impediments to their goods and services coming here. Meanwhile, we’d do next to nothing to get their governments to return the favor.

Trump thought this was dumb. In no small part – because it’s dumb.

Trump proposed the weird notion that America’s government should first and foremost look out for – American companies and its people. More

iEverything tiny little company Apple (market cap: $820 billion) is in the midst of executing a unilateral war against Qualcomm.

Apple Sues Qualcomm Over Patent Royalties: “Apple also wants back some of the billions of dollars it claims it was overcharged in ‘Qualcomm’s illegal scheme’ to control the market for mobile phone chips.”

No, what Qualcomm is doing – is engaging in a legal, very reasonable effort to control the market for its patents.  Apple wanted to use Qualcomm’s patents, Apple signed contracts to use them, Apple uses them – and now Apple is trying to get out of paying for using them.

Oh – and to put this in technological perspective: The iPhone – without Qualcomm’s patented technologies – is basically a skinny rotary phone. Just about all the things that make an iPhone an iPhone – come from Qualcomm. More

Remember the overtime-session, hanging chad, 2000 George W. Bush v Al Gore presidential election? Where it all came down to Florida – and Gore unsuccessfully sued to overturn the Sunshine State’s certification of Bush as its winner?

I remember. I was working on the Bush side of the ledger – in Austin, Texas. Part of the decade I spent living in the Live Music Capital of World. (Austin is nice – because it is so close to Texas.)

The hanging chads – left the Left going nuts. Well, it afforded the Left another opportunity to again demonstrate that they’ve all along been nuts.

They screeched about the antiquated paper ballots with the punch holes (partial punching of which resulted in the aforementioned hanging chads.) They demanded that these antiquated technologies be eschewed: “The academic study concluded that many of the mechanical and human problems experienced last November could be solved if counties eliminated punch cards and lever machines.”
