The Obama Legacy: If It Lives by ‘Executive Action’ – It Should Die by ‘Executive Action’

Substitute for Legislation

A hallmark – perhaps the hallmark – of the Barack Obama Administration is the “executive action.” The unilateral changes in law – oft major in size and scope – executed by the Executive Branch. Completely devoid of any Legislative Branch participation.

After the American people repudiated President Obama’s agenda in the 2010 midterm election – by electing a Republican House of Representatives to block it and him – the President famously said “We are not just going to be waiting for legislation in order to make sure that we’re providing Americans the kind of help that they need. I’ve got a pen – and I’ve got a phone. And I can use that pen to sign executive orders and executive actions.”

This isn’t how the Constitution calls for things to be done. Laws are supposed to originate in the Legislative Branch. And you know who knew this? Then-Senator Barack Obama.

When campaigning for the presidency, he said about then-President George W. Bush: “I taught Constitutional law for ten years. I take the Constitution very seriously. The biggest problems we’re facing right now have to do with George Bush trying to bring more and more power into the Executive Branch – and not go through Congress at all. And that’s what I intend to reverse when I am President of the United States of America.”

Once in office, it wasn’t “reverse” – so much as it was “slam it in drive and floor it.” More

Indeed We Can’t

Terrible, economy-destroying policy. Delivered not by Congress – but by unilateral executive branch fiat. Delivered as special favors to political cronies.

That’s been the last eight years in a nutshell. Do we want it for another four? That’s the question Americans need to ask themselves as they head to the polls tomorrow. (Millions of people have already voted – which is itself terrible policy. It’s like having a trial – and allowing half the jury to render a verdict halfway through the case.)

A perfect microcosm of the dictatorial Barack Obama Administration – is the Obama Administration’s Federal Communications Commission (FCC). Run with an iron fist by a President Obama Mini Me – Chairman Tom Wheeler.

Who, like President Obama, has thrown out the window all attempts at sound policy based on rational analysis and imposed through normal processes. And has instead repeatedly jammed through terrible, crony-pleasing fiats in hyper-partisan fashion.

The FCC is made up of four voting Commissioners and a voting Chairman. The Chairman and two Commissioners are of the President’s Party – two of the opposition Party. So it has been 3-2 Democrat. More

It’s how this country became the economic light of the world. Talented people – free to do amazing things. They become fabulously wealthy – and make all our lives better and richer.

Your computer, your phone, your car, your home’s television, heater and air conditioner and millions of other life-bettering things – created by talented people availing themselves of the free market opportunities this nation gave them.

Of course, some people are more talented than others. Not everyone is Steve Jobs or Bill Gates. Once upon a time, the less-extraordinarily-brilliant appreciated and admired the best of the best.

But we have spent the last half-century-plus training Americans not to appreciate accomplishment and pursue it themselves – but to envy others’ success, and want society to punish them for having the audacity to excel.

And that’s where government comes in. Populated in far, far too many instances by people steeped not in the pursuit of excellence – but in its persecution.

If these people were actually good at productive work – they would be doing productive work. But they’re not. So they’re professional scolds and busybodies – government bureaucrats lording over those doing productive work.

Those who can – do. Those who can’t – regulate those who can. More

Not Sure That’s a Good Idea, Actually

Today is Halloween 2016. Which means the Barack Obama Administration is running out of time to issue government power grab payouts to the cronies that ensconced them in office.

Which brings us to last Thursday at the administration’s Federal Communications Commission (FCC). The ridiculous FCC jammed through a ridiculous power grab – on which just a month earlier the Commission’s own three unelected Democrats couldn’t even agree.

But the administration’s expiration date approaches – so the three Donkeys got in line. And in their “I’m a Congressman” costumes unilaterally rewrote law – and again jammed the private Internet sector.

The media water carriers – as always in their “Objective Journalist” costumes – call what the FCC did a move to “protect privacy.” What the FCC actually did was issue another power grab that hurts everyone – except Google, Facebook, Netflix and the other cronies. Tricks for us – treats for them. Happy Halloween, All.

The FCC did this by writing brand new law – again, without benefit of Congress – for how Internet Service Providers (ISPs) collect and use data. Their new “law” – is unequal treatment before the law. It is far more stringent on and punitive of ISPs – than the actual laws are on Google, Facebook, Netflix and the other cronies. If Only They’d Worked for the FCC

Yes, you read that correctly. The hypocrisies and the broader metaphors are opulent.

The Federal Communications Commission (FCC) is an outmoded, outdated federal agency. Like many, many of its cohorts – it has long outlived its usefulness. It no longer has any unique reason for its continued existence – nothing that couldn’t be handed off to any other of the thousands of government agencies.

Which is why it spends much of its time issuing unilateral regulatory fiats – to power grab things for it to do. Idle bureaucrat hands are the Devil’s playground.

Originally birthed in 1927 as the Federal Radio Commission, it served a couple of minor, pedestrian purposes. Mostly, initially, to ensure radio signals didn’t interfere with one another.

But this is DC. And in DC, mission creep is inexorable. Every agency looking – through Congressional legislation, or unilateral fiat – to ever-expand its portfolio. Which brings us to the FCC’s sex, porn and power grabs.

One of the things the FCC does now is punish television and radio broadcasters for obscene, indecent and profane broadcasts. Perhaps the most famous instance was the 2004 Super Bowl XXXVIII halftime show. During which singer Justin Timberlake exposed singer Janet Jackson’s breast.

The FCC levied a $550,000 fine on the “offending” network – CBS. CBS contested the fine all the way to the Supreme Court. The Court ruled in the FCC’s favor – but CBS appealed, and the Third Circuit Court of Appeals dumped the fine. The FCC tried to reinstate, but the courts refused them. More

We all know most of the modern Tech World is very, very Leftist.   And has been from its mid-1990s inception. Which is ok. But all the while, the relationship between the Tech World and our $4-trillion-per-year Leftist government has grown exponentially. Which ain’t nearly so ok.

The harmonic convergence has been the Barack Obama Administration. Which has actually been the Silicon Valley Administration – issuing Tech-favoring crony regulations like a Pez dispenser. Google has been a particular insider favorite. Social media monster Facebook has also all along been deep in the tank for senator-cum-president Obama. Etc, etc, etc. The Silicon Valley is nigh totally a Leftist ideological tar pit.

The Atlantic just polled a panel of Silicon Valley heavy hitters. The results are…unsurprising. 88% of them are voting for Democrat Hillary Clinton for president. ZERO percent of them are voting for Republican nominee Donald Trump – not one person. Shocker.

We conservatives don’t mind people who disagree with us. Less and less, however – the Left isn’t returning the favor.

In New York, Justice’s Left Eye is Open

If you want justice, equal protection before the law and prosecutorial humility – New York Democrat Attorney General Eric Schneiderman ain’t your guy.

If you want partisan, selective persecution and ideological witch hunts – you can not do any better than AG Schneiderman.

The Clinton Foundation is located on Avenue of the Americas in New York City – the heart of AG Schneiderman’s purview. It is a multi-multi-million-dollar den of corruption. Time after time billion dollar promises have been made – but never kept. In 2013, only 10% of the money the Foundation spent went to, you know, actual charity. They spent more on office supplies. And, of course, rent – palatial offices on Avenue of the Americas ain’t cheap.

All the while, the Foundation was a global, nigh-limitless cash withdrawal system – taking hundreds of millions of dollars from governments with business before then-United States Secretary of State Hillary Clinton.

It is a chief reason why Mrs. Clinton never used her government email address and its monitored, recorded system – so no one could track the confluence of State Department and Clinton Foundation action.

Is AG Schneiderman at all interested in looking into any of this? Of course not. Because Hillary Clinton is a fellow Democrat. And she’s now the Party’s presidential nominee. Can’t foul that up with enforcement of the law. Ask James Comey. More
